DUI driver gets 18 years for wreck that killed his father

SAN DIEGO (CNS) – A repeat DUI offender who drove drunk and crashed his car into two trees off state Route 94, killing his 60-year-old father, was sentenced Thursday to 18 years and four months in state prison.

Marciano Flores Jr., 28, pleaded guilty last month to gross vehicular manslaughter, assault with a deadly weapon and DUI with injury.

“This is a very sad case for everybody involved,” said Superior Court Judge Timothy Walsh.

The defendant — who had previous DUI convictions from 2005 and 2006 — was initially charged with second-degree murder because he was considered a risk to public safety, said Deputy District Attorney Robert Eacret.

The prosecutor said the unique circumstances of the case moved prosecutors to accept a defense offer to plead guilty to lesser charges.

Eacret noted the assault charges stemmed from Flores’ “reckless action” on the freeway the night of Aug. 2, 2013, traveling at speeds of more than 100 mph and almost hitting a number of vehicles before running off the road west of state Route 15.

Marciano Flores Sr., who was riding in the front passenger seat, died at the scene.

His son’s blood-alcohol content was measured at 0.19 percent — more than two times the legal limit — an hour after the 11 p.m. crash.

The victim’s granddaughter, Gisselle Cote, told the judge that the family didn’t hold the defendant accountable for the crime, and was confident her grandfather wouldn’t blame his son either.

Anna Flores, the victim’s daughter, said her father and her brother were best friends.
